The Board will consider recommendations from staff regarding the acquisition of property for construction
of the Lusby Southern Connector Road.
2. Legal Matter [10-508 (a)(7)]
The Board will consult with the County Attorney regarding the Board of County Commissioners’ easement
rights concerning the Schmeiser property.

Summary of Actions Taken
Tuesday, December 13, 2005
Re-appointed Christopher Donley, Everard Johnson, Craig Mask, Ronald Mattera, and appointed Mark Spicknall to the Calvert County Agriculture Committee.
Appointed First Sergeant Dave McDowell, Reverend Charles T. Brown, and Reverend Victor Simpson to the Calvert County Family Network.
Re-appointed Frederic N. Dellinger and Barbara A. Moyers to the Cove Point Light Station Commission.
A presentation was given on the audit report for Calvert County by Terry Shannon, Director, Department of Finance and Budget, and auditors John Crawford and Paul Bevard of Murphy & Murphy, CPA, LLC. The report did not note any instances of non-compliance with laws or regulations. Calvert County is in excellent financial condition, with net assets at approximately $166.1 million, which is an increase of $19.1 million from the prior year. The County ended the year with a budgetary surplus of $7.8 million, partly due to strong receipts in recordation taxes and income taxes. The largest primary revenue source is property taxes, with the Board of Education being the largest expense. The fiscal policies and procedures of Calvert County are conservative, with strong internal controls.
Adopted Approach #2, Option A, 7 year phase-in for all water and sewer systems effective January 1, 2005, with this new rate appearing on the March 31, 2006, water and sewer bills.
Directed County Attorney to generate provisions relating to fuel escalation and de-escalation to include future contracts.
Approved budget adjustment #253, in the amount of $18,606.32, from theCommissioners Contingency Fund to be used for the additional legal and engineering expenses incurred for the law suit with the Chesapeake Ranch Water Company.
Authorized the President of the Board to sign the letter of support for the Town of Chesapeake Beach’s Rails to Trails Grant application, allowing for approximately 900’ of the trail to cross through County-owned property at Fishing Creek Park.
Approved the following increases for the County’s elected positions based on recommendations from the 2005 Compensation Review Board to be submitted for approval during the 2006 Legislative Session, and would be effective 2006 – 2009:
Judges of the Orphans Court: an increase of $250 per year
Treasurer: an increase of $1,375 per year
Sheriff: an increase of $3,000 for 2006, with an increase of $1,000 per year thereafter
Commissioners: an increase of $1,000 per year, with the President’s salary higher by $2,500
Tabled contract discussions regarding the Dunkirk Southwest Corridor and directed staff to bring this back as a work session.
Approved Change Order no. 2, in the amount of $62,234 for the Hallowing Point Park Tennis Courts for unforeseen items related to very poor soil conditions.
Approved the formula for funding annual Cost-of-Living Adjustments (COLA) for County employees as presented by the Calvert Employee Representative Committee (CERC), which will use the consumer price index (CPI) covering the period from October 1 through September 30, rounded to the nearest hundredth position, which is the same as the Board of Education’s formula, but without a 3.5% cap.
Approved Gambling Permit Applications for the first quarter of 2006 for American Legion Post #85, American Legion Post #206, American Legion Post #274, Dunkirk Volunteer Fire Department, and Huntingtown Volunteer Fire Department.
Approved the Certification of Development Options application submitted by Young D. Hance and Susan Hance Wells for APD #05-16, allowing for 107 development options.
Approved the Certification of Development Options application submitted by Joseph R. Sutton and Arta L. Sutton for APD #95-6, allowing for 116 development options.
Approved the conversion of lots to 2½ Transferable Development Rights (TDRs) for Stephen C. and Rachel J. Piazza of Chesapeake Ranch Estates (#05-10).
Approved the conversion of lots to 2½ Transferable Development Rights (TDRs) for Frederick Mumma of Chesapeake Ranch Estates (#05-12).
Approved the revised organization chart for the Department of Planning and Zoning and approved budget adjustment 259, in the amount of $78,383, to be moved from the Recordation Tax account to the Planning and Zoning accounts in order to implement the revised organization chart.
Approved the lease with DWI Services, Inc. as presented, and authorized the President to sign said lease.
Directed staff to find out what can be done about the trash from area businesses that ends up on Kirksville Lane in Dunkirk, and to look into the water run-off problem as well.
Authorized staff to enter into negotiations for the acquisition of property for construction of the Lusby Southern Connector Road.
Agreed to the readjustment of lots and open space for the Schmeiser property so that it may be presented to the Planning Commission.
