IMPORTANT NOTICE
BOARD OF APPEALS DEADLINE &
APPLICATION PROCESS REVISED

Please make note of the following changes that have been made to the Board of Appeals process:
Effective immediately, the deadline for submittal of Board of Appeals applications is now the third Thursday of any month for consideration at the next available hearing, which shall be no less than 6 weeks hence. Properly filed applications will be placed on the next available agenda based on their receipt date. Properly filed applications are those that include all the information required in the application form. Every effort will be made to place timely-filed applications on the agenda for the first available hearing. However, once an agenda is deemed full, meaning the caseload indicates it will take an entire ordinary working day to complete, subsequent applications will be placed on a succeeding month’s hearing agenda. Cases that have been deferred for further information or revisions will be rescheduled when the required information or revisions have been received. Those cases will be placed on the next available hearing agenda, in accordance with the requirements noted above. In no case will deadlines be extended to include applications that were not timely filed. The earlier submittal date should allow time to distribute comments prior to the hearing.
Applicants must now provide a referral form when the Board of Appeals application is filed. The referral form must be signed by the planner in the Department of Planning and Zoning who is ultimately responsible for approving the project. This will require an initial review by that staff member prior to filing an application for review by the Board of Appeals. It is our intention that this requirement will facilitate the process, reduce the potential for errors, and hopefully eliminate the need for multiple hearings on the same project by the Board. Please incorporate sufficient time in your application process to include consultation with the appropriate staff member. Applications filed without the referral form will be returned to the applicant. The only exceptions to the referral form requirement are cases that involve Decisions on Alleged Errors and Reconsideration Requests.
The application form has been changed to include the requirements noted above and to clarify the minimum level of detail required for each application type. Please use the form as a checklist when preparing an application for filing. Failure to file the required information will likely result in a delay to scheduling of your case, as incomplete applications will be returned for completion before scheduling.
